By accessing or utilizing the services provided by Mytheast (referred to as the "Products" or "Services"), or accessing and utilizing any content available within Mytheast, you acknowledge and agree to be bound by the Terms & Conditions of Use.

 

1. Utilizing the Products

Mytheast provides you with a non-exclusive, non-transferable license to access the web services offered by Mytheast and to access the content (referred to as "Content" hereinafter) contained within, all in accordance with the aforementioned Terms.

 

2. Limitations on Usage

Unless you have obtained prior written authorization from Mytheast (or, where applicable, from the provider of specific Content), you are prohibited from:

 

You are prohibited from accessing or utilizing the Products or any Content through any technology or means other than those explicitly provided by Mytheast or explicitly authorized by Mytheast;

You are prohibited from copying, translating, modifying, or creating derivative works of the Content or any part thereof;

You are prohibited from redistributing, sublicensing, renting, publishing, selling, assigning, leasing, marketing, transferring, or making the Products or Content available to third parties;

You are prohibited from reverse engineering, decompiling, or attempting to extract the source code of the Service or any part thereof, unless expressly permitted or required by applicable law;

You are prohibited from using the Products in a manner that allows you or any other person to access mass downloads or bulk feeds of any Content, including but not limited to images, photos, thumbnails, image tiles, or panoramic photos or videos in any other format;

You are prohibited from crawling, scraping, or caching any content from Mytheast, including but not limited to user profiles and user-generated content;

You are prohibited from accessing Mytheast's private API through any means other than the www.mytheast-vr.com website;

You must not delete, obscure, or alter in any manner any warning, notice (including but not limited to any copyright or other proprietary rights notice), or link that appears in the Products or the Content;

You must not modify, adapt, or hack Mytheast or modify another website in a way that falsely implies association with Mytheast.

 

3. Appropriate Conduct

Compliance with Laws and Mytheast Policies: You acknowledge that you are responsible for your own conduct and the content you submit, post, or display while using the Products, and for any consequences thereof. You agree to use the Products only for lawful, appropriate purposes in accordance with the Terms and any applicable policies or guidelines provided by Mytheast. You further acknowledge that you are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, links ("Content") that you submit, post, and display on the Mytheast service.

 

As an illustrative list, without limitation, you agree that while using the Products or the Content, you will refrain from:

 

Defaming, abusing, harassing, stalking, threatening, or otherwise violating the legal rights (such as privacy and publicity rights) of others;

Uploading, posting, emailing, transmitting, or otherwise making available any inappropriate, defamatory, obscene, or unlawful content;

Uploading, posting, transmitting, or otherwise making available any content that infringes upon any patent, trademark, copyright, trade secret, or other proprietary right of any party, unless you are the rightful owner of such rights, or have obtained permission from the owner or possess other legal justification to use such content;

Uploading, posting, emailing, transmitting, or otherwise making available messages that promote pyramid schemes, chain letters, or disruptive commercial messages or advertisements;

Uploading, posting, emailing, transmitting, or otherwise making available any other content, message, or communication prohibited by applicable law, the Terms, or any applicable Product policies or guidelines;

Downloading any file posted by another user that you know, or reasonably should know, cannot be legally distributed in such manner;

Impersonating another person or entity, or falsifying or deleting any author attributions, proprietary designations, or labels indicating the origin or source of Content, software, or other materials;

Restricting or inhibiting any other user from using and enjoying the Products or Mytheast services;

Interfering with or disrupting Mytheast services, servers, or networks connected to Mytheast services, or disobeying any requirements, procedures, policies, or regulations of networks connected to Mytheast services;

Using any robot, spider, site search/retrieval application, or other automated device to retrieve any portion of the Mytheast services or Content, or collect information about users for any unauthorized purpose;

Submitting content that falsely expresses or implies sponsorship or endorsement by Mytheast;

Creating user accounts through automated means or under false or fraudulent pretenses;

Promoting or providing instructional information about illegal activities;

Promoting physical harm or injury against any group or individual; or

Transmitting any viruses, worms, defects, Trojan horses, or any items of a destructive nature.

 

4. Guidance for Parents

At Mytheast, we prioritize the safety and privacy of all our users, especially children. Parents must confirm that they are at least 18 years old if they have children under the age of 13 who are allowed to access areas of Mytheast. Furthermore, parents must verify that they are the legal guardians of the child/children and grant them permission to access Mytheast. As the legal guardian, we urge you to assess whether any Mytheast content is appropriate for your child.

 

5. Content Monitoring

Content monitoring: Mytheast does not assume any obligation to monitor third-party content.

 

6. Content within the Products

Mytheast enables you to access and view a wide range of content, including but not limited to photographic imagery, map and terrain data, business listings, and other relevant information provided by Mytheast, its licensors, and its users (referred to as the "Content"). You acknowledge and agree that Mytheast, its licensors, and users retain all ownership rights to the Content. Unless specifically permitted by Mytheast or the owner of the Content in a separate agreement, you may not utilize, access, or permit others to utilize or access the Content in any manner that is not authorized under the Terms.

 

7. Trademark & Copyright Violation

If you believe that your copyrighted content has been posted on Mytheast without the necessary authorization, and you are the copyright owner or an authorized agent, you may submit a notification of copyright infringement. However, before proceeding, please consider if exemptions such as Freedom of Panorama, fair use, fair dealing, or similar copyright exceptions apply. It's important to note that requesting content removal through an infringement notification initiates a legal process, and submitting a false or misuse notification may have legal consequences. 8. Disclaimer of Warranties and Limitations of Liability

Mytheast and its licensors do not make any representations or warranties regarding the accuracy or completeness of any Content or the Products.

Mytheast and its licensors disclaim all warranties related to the Content and the Products and will not be held liable for any damages or losses resulting from your use of the Content or the Products.
